A federal class action lawsuit claims Chrysler Group sold and leased 2002-2007 Jeep Liberties with defective window parts that cannot be repaired.
The defective Jeep Liberty class action lawsuit alleges Chrysler designed, manufactured, sold and leased 2002-2007 Jeep Liberties containing permanently defective Window Regulators that cannot be successfully repaired, despite repeated attempts to do so.
"The defective Window Regulators cause the windows in the Covered Vehicles to bind, stick, tip forward, chatter and fall to the bottom of the door. Often the windows suddenly and loudly fall or drop out of position and down into the inside of the door frames. These failures occur when the windows are in a partially or closed position. The windows also stick in all positions, including closed, partially closed and totally open. In these instances, it is impossible to move the window to open or close it further. These failures occur while the motor is off and while it is running; the failures also occur while the Covered Vehicles are standing still and while the Vehicles are being operated at all speeds," states the Jeep Liberties class action lawsuit.
"These sudden, loud and crashing failures result in a shocking exposure to weather and debris, putting the driver and passengers, including children, at great risk of danger. Moreover, the unexpected inability to close or open a failed window poses a substantial and unacceptable safety risk for persons and property inside the vehicles. As a result of these defective Regulators, the Covered Vehicles are unfit for the use for which they were intended in that they cannot be driven safely."
The Jeep Liberty defective window regulator class action lawsuit continues to say that since these vehicles are manufactured, marketed, advertised, sold and leased by Chrysler as "off-road" vehicles, that the defect prevents the exact use for which the Jeep Liberties were intended because the regulators sometimes fail with any jarring or an uneven roadway.
Even after vehicle owners attempt to repair the defective Jeep Liberty window regulators, the class action lawsuit claims the regulators continue to fail and break because Chrysler "merely replaces the defective parts with identical defective parts."
The Jeep Liberty class action lawsuit is brought on behalf of a proposed class of individuals and entities nationwide who purchased or leased a model year 2002-2007 Jeep Liberty manufactured by Chrysler Group. The class action also includes a state-specific California subclass. It is asking that Chrysler promptly repair and/or replace all defective window regulators for free, award damages and restitution to class members, and provide other relief.

UPDATE: The plaintiff in this case voluntarily dismissed the Jeep Liberty class action lawsuit in February 2011, and later joined a new class action lawsuit filed by lead plaintiff Steven Doyle in April 2013. That case continues with a May 1, 2014 motion by Chrysler to dismiss. Plaintiff lawyers shot back on May 1, urging a federal judge to deny the motion.
